Terms and Conditions for Little Tagger

These Terms and Conditions ("Terms") govern your access to and use of the Little Tagger application (the "App"), provided by Fox+Rabbit Innovation Design GmbH ("Company," "we," "us," or "our").

Please read these Terms carefully before using the App. By accessing or using the App, you agree to be bound by these Terms and all terms incorporated by reference. If you do not agree to all of these Terms, do not use the App.

1. Acceptance of Terms

By downloading, installing, or using the App, you signify your agreement to these Terms. If you are using the App on behalf of an entity, you represent and warrant that you are authorized to accept these Terms on that entity's behalf, and that entity agrees to indemnify us for violations of these Terms.

2. Changes to Terms

We reserve the right to modify or revise these Terms at any time. We will provide notice of such changes by updating the "Last Updated" date at the top of these Terms and/or by providing additional notice (such as by sending an email notification or displaying a notice within the App). Your continued use of the App after any such changes constitutes your acceptance of the new Terms. If you do not agree to any changes, you must stop using the App.

3. Privacy Policy

Please refer to our Privacy Policy, available within the App or at /privacy-policy, for information on how we collect, use, and disclose information from our users. You acknowledge and agree that your use of the App is subject to our Privacy Policy.

4. License to Use App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use.

5. Prohibited Conduct

You agree not to:

  • Use the App for any illegal purpose or in violation of any local, state, national, or international law.
  • Violate or encourage others to violate any right of a third party, including by infringing or misappropriating any third-party intellectual property right.
  • Interfere with security-related features of the App, including by (a) disabling or circumventing features that prevent or limit use or copying of any content; or (b) reverse engineering or otherwise attempting to discover the source code of the App or any part thereof except to the extent that such activity is expressly permitted by applicable law.
  • Interfere with the operation of the App or any user's enjoyment of the App, including by (a) uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code; (b) making unsolicited offers or advertisements to other users of the App; (c) attempting to collect personal information about users or third parties without their consent; or (d) interfering with or disrupting any networks, equipment, or servers connected to or used to provide the App, or violating the regulations, policies, or procedures of such networks, equipment, or servers.
  • Perform any fraudulent activity including impersonating any person or entity, or falsely claiming an affiliation with any person or entity.
  • Sell or otherwise transfer the access granted herein or any Materials (as defined in Section 7) or any right or ability to view, access, or use any Materials.

6. In-App Purchases and Subscriptions

The App may offer certain features or content for purchase ("In-App Purchases") or through a subscription model ("Subscriptions").

1. In-App Purchases

  1. All In-App Purchases are processed through the respective app store (e.g., Apple App Store, Google Play Store) and are subject to their terms and conditions.
  2. Prices for In-App Purchases are displayed within the App and may vary based on region and currency.
  3. All sales of In-App Purchases are final. We do not offer refunds for In-App Purchases, except as required by applicable law or as explicitly stated in the app store's terms and conditions.

2. Subscriptions

  1. Subscriptions may grant you access to premium features or content for a specified period.
  2. Subscriptions will automatically renew at the end of each subscription period unless canceled by you.
  3. You can manage and cancel your Subscriptions through your app store account settings.
  4. Cancellation of a Subscription will take effect at the end of the current billing cycle, and you will continue to have access to the subscribed features until that time.
  5. We reserve the right to change subscription fees at any time. Any price changes will be communicated to you in advance, and you will have the option to cancel your Subscription before the new price takes effect.

3. Free Trials

  1. We may offer free trials for certain Subscriptions.
  2. If you sign up for a free trial, you may be required to provide payment information.
  3. At the end of the free trial period, your Subscription will automatically convert to a paid Subscription, and your payment method will be charged, unless you cancel the Subscription before the trial period ends.
  4. You can cancel your free trial at any time through your app store account settings.

4. Payment Information

  1. By making an In-App Purchase or subscribing, you authorize the respective app store to charge your designated payment method for all applicable fees.
  2. You are responsible for ensuring that your payment information is accurate and up-to-date.
  3. We are not responsible for any charges or fees incurred due to outdated or incorrect payment information.

7. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App, including, but not limited to, your User Contributions, any use of the App's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the App.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
